Conveyancing is the process of transferring legal ownership of a property from one person to another.
What does a conveyancing solicitor do?
Conveyancing solicitors undertake all the legal work involved in the sale or purchase of a property.
These are the main conveyancing steps when you buy a home:
1. Initial checks
Your conveyancing solicitor completes initial paperwork which includes asking you for proof of identification and proof of address. They also carry out anti-money laundering checks.
2. Contract pack
The seller’s solicitor sends your solicitor a contract pack which includes a property information form and a fittings and contents form. Your solicitor checks this paperwork and raises any queries with the seller’s solicitor, for example, issues with boundary lines.
3. Searches
Your solicitor undertakes property searches. This includes local authority and planning searches to check for problems that could affect the value of the house.
They will also order a drainage and water search, environmental search, flood risk search and Land Registry pre-completion search. The latter ensures the person selling the property to you has the legal right to do so.
Depending on the property and location, other searches may also be needed.
4. Transfer deed and final searches
When all queries have been settled your solicitor sends you the transfer deed to sign. This document transfers property ownership from the seller to you. If you are taking out a mortgage you also sign a mortgage deed.
Your solicitor then conducts final checks with the Land Registry to make sure there have been no changes since initial searches were carried out.
5. Exchange of contracts
The transfer deed and contracts are exchanged between your solicitor and the seller’s solicitor. At this point you are legally committed to the purchase, and a moving date is agreed.
6. Completion of sale
Money for the purchase is transferred from your solicitor to the seller’s solicitor. Once the money has cleared you can move into your new home.
7. Post completion
Following completion your solicitor completes the legal side of your property purchase. They register the property in your name with the Land Registry and pay any stamp duty land tax due to the HMRC.
Your solicitor then invoices you for all disbursements (fees they have paid to third parties on your behalf).
